1. Introduction

1.1 We are committed to safeguarding your privacy and this policy explains how we will do that.  

1.2 This policy applies where we are acting as a data controller with respect to any individual’s personal data.

1.3 Where we store and use your  information, it will be used in accordance with the Data Protection Act 1998 and the General Data Protection Regulation (GDPR).

1.4 In this policy, “we” and “us” refer to TVA GROUP Limited. You or your means you.

2. TV Panel

2.1   We provide the software application running an audience measurement service called “TV Panel” on a selection of television channels. The list of participating channels is available via www.tvpanel.tv/channels.

2.2 When you watch a participating TV channel for the first time, you will be notified via a ‘pop-up message’ which appears on your TV.  The pop-up message will disappear after a short period or you can remove it by pressing the button indicated on your TV remote control. The pop-up message will appear on the first participating TV channel that you happen to watch but the notification applies to all participating TV channels.

2.3 The pop-up message may additionally invite you to consent to provide additional information (see below) or you can choose to object to participating at any time by pressing the Yellow button on your remote control. After you have taken the action requested, you should not see a pop-up message on any participating TV channel for 12 months unless you carry out a factory reset for you TV receiver whereupon you will be re-presented with a pop-up message. If you choose to object to taking part, you will not be re-presented with a pop-up message unless you carry out a factory reset for you TV receiver whereupon you will be re-presented with a pop-up message.

2.4 This policy will explain what we do and how you can opt in or object to participating in TV Panel.  This policy will govern the use of the TV Panel service.

3. What we do with the information

3.1 In this section we have set out:

(a) the general categories of data that we may process; and

(b) the purposes for which we may process any personal data; and

(c) the legal bases of the processing.

3.2 We may process data about the participating TV channels you watch (“Usage data“). The Usage data is anonymised (i.e. it cannot be used to identify you or your household either directly or indirectly) and it is processed and aggregated for all participating TV channels. The Usage data includes information about the timing, frequency and pattern of participating TV channels that you watch; the make and model of the TV receiver or set-top box, and other metadata from the TV signal. This Usage data may be processed for the purposes of analysing the use of the participating TV channel(s) and services. The legal basis for this processing is the legitimate interests of the participating TV channels namely to improve their offering and to continue to offer services free to air to you. If you wish to object to this legitimate interest, you can do so by writing to us at the address provided below.

3.3 Where you explicitly consent, we may also process additional information (“Consent data”) such as your broadband IP address, geographical location and we may use the Consent data to help deliver other services, including to personalise features and content and make suggestions for you (such as tailored promotions or programmes that you may be interested).  You can grant your consent either by following the on screen instructions on your television or by writing to us at the address given below. You can also object at any time by pressing the Yellow button on your remote while watching a participating channel or by writing to us at the address given below and we will provide instructions to enable TV Panel to cease to collect any Consent data and you will no longer benefit from TV Panel services.

3.4 We may process information contained in or relating to any communication that you send to us (“Correspondence data“). The correspondence data may include the communication content and metadata associated with the communication. The correspondence data may be processed for the purposes of communicating with you and record-keeping. The legal basis for this processing is our legitimate interests, namely the proper administration of our website and business and communications with you.

3.5 We may disclose Usage data and Consent data to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy.

4. Retaining and deleting data

4.1 This Section sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

4.2 Usage and Consent data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

4.3 We will retain data as follows:

(a) Usage data will be retained for a maximum period of 24 months; and .

(b) Consent data will be retained for a maximum period of 24 months

4.4 Notwithstanding the other provisions of this section, we may retain data where such retention is necessary for compliance with a legal obligation to which we are subject to a court order and we may retain anonymised information that a period we choose.

5. Ownership and use of content

5.1   All text, data, databases, charts, tables, software, images, photographs, illustrations, artwork, names, logos, and other material shown as a pop-up on participating TV channels and on the Website (the “Content”) and all rights in it belongs to TVA Group or are licenced to TVA Group by third parties. Content may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any other way, without prior written permission from TVA Group. 5.2   If you make a copy of a pop-up or any part of this Website, you agree not to alter, amend, copy or create a derivative work from any of the Content or to use it for any purpose other than for your personal and non-commercial use.

6. Intellectual property rights

6.1   All copyright, data rights, logos and other intellectual property rights that may exist in TV Panel and this Website, including the content, are the property of TVA Group Ltd.

6.2   Nothing on this Website should be construed as granting, by implication or otherwise, any licence or right to use the logos, content or data without written permission from TVA Group Ltd. The name of TV Panel  or TVA Group may not be used in any way, including in advertising or publicity pertaining to distribution of content or data without the prior written permission of TVA Group.

7. Liability

7.1   TV Panel data (in whatever form) are the results of complex audience measurement and algorithms that produce probabilistic measures of viewing audience sizes. We do not warrant the accuracy of the data and, except as required by law, accept no liability of any kind to any person in relation to the data including liability for errors or defects in or omissions from the data, delays in publication of the data or any breakdown, failure or cessation of the audience measurement service, however it occurs.

7.2 In no event will we be liable for any loss including, without limitation, indirect or consequential loss, or any damages arising from loss of use, data or profits, whether in contract, tort or otherwise, arising out of or in connection with the use of the TV Panel Service,  Website or data.

7.3   We are not responsible for the availability or content of any third party websites or material you access through this Website.

8. Changes to the policy

8.1 We may update this policy from time to time by publishing a new version on our Website.

8.2 You should check this page occasionally to ensure you are happy with any changes to this policy.

8.3 The policy is governed by and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts.
